Pengalaman Menjual Rumah Sendiri - Part 4

Ada orang hantar e-mail tanya macamana nak buat surat "Offer To Purchase ". Memanglah kena buat surat ni bila dah dapat confirm buyer dan nak terima 2% tu deposit daripada buyer. Kalau jual melalui agent senang je, agent yang keluarkan surat/form ni, kita just sign je. Tapi yang tak bestnya, 2% tu masuk kocek agent hehehe.

Yang penting kena dapatkan contact lawyer dulu. Kalau buyer takde contact (jarang-jarang berlaku), kita dapatkan contact lawyer untuk buyer.

Aku just copy Letter Offer to Purchase daripada agent sebelum ini. Takpelah plagiat, dia pun dah dapat 15k daripada penjualan rumah aku sebelum ini.

Format dia lebih kurang macam kat bawah ni, kalau korang biasa karang surat rasmi, macam itulah rupa dia:

Kat bahagian ni tulis Property Details:
HSD, PT, No rumah, Jalan etc

Then tulis Seller is satisfied with the condition of the said property, hereby offer to purchase the Property on the following terms and conditions with the SPA Price stated below:

1) Payment

a) 2%...of X shall be paid being the earnest deposit simultaneously upon executing this letter.

b) 8% balance upon execution and signing SPA. Make sure buyer dah dapat loan masa sign SPA.

c) 90% to be paid 3 months after signing SPA. Kadang buyer nego 3 + 1, 5 ataupun 6 mths after dapat consent (for leasehold). Ikut budi bicara koranglah. Freehold biasanya 3 bulan dah settle.

2) Cara serahan kunci - 5 days after completion Sale and Purchase transaction.

3) Deadline untuk sign SPA.
Deadline sign SPA 21 hari daripada (a) above. Aku akan forfeit 1% kalau loan tak lepas (a), bunyinya macam kejam tapi kita kena profesional so that aku boleh filter hanya buyer yang betul-betul layak dan serius.

4) Default by parties after signing (a) - ni untuk protect buyer and seller.
Macamana kalau buyer tak nak teruskan pembelian after signing (a)..forfeit 100%

Macamana kalau seller tak nak teruskan urusniaga (eg dapat better offer)..etc

5) Tuliaslah terima cheque X amount payable to vendor.
